MonitorThe newly created Shchastya territorial community, by the decision of the CEC, was unable to hold elections in October 2020. This has led to the fact that CAA do not have the right to dispose of the property of the community, and the actual power in the created AH does not exist. The biggest problem with this is that some social infrastructure facilities do not yet have a balance holder. Namely, they do not have the opportunity to conclude a contract for the supply of electricity.
Since December, Luhansk Energy Association LLC (hereinafter referred to as Leo) has started sending letters notifying it of the need to re-sign the contract and warning it about disconnecting from the network. Namely, the following objects are the School of Arts (Shchastya), Trekhizbenskaya secondary school and preschool institution "Romashka" (Trekhizbenka village). These objects were on the balance sheet of the Novoaydar District Council. On 27.01.2021, the VCA of Shchastya appealed to the head of Leo LLC with a request to postpone the shutdown for several weeks while a special financial body is being formed. It will allow you to conclude a contract and make payments. But the answer of the energy supplier was unequivocal – according to the current legislation, they do not have the right to supply electricity to subscribers without a contract. At the same time, it was announced that the provision of services under the scheme proposed by the CAA will not be profitable for Leo LLC.
On the air, a representative of the electrical supplier has already announced that the Shchastya School of Arts and a number of other organizations were disconnected from the power grid. Electricity supply will be restored when service supply contracts are signed.
Групою посередників ГІСМАОВК було проведено ряд експертних зустрічей щодо ситуації з відключенням соціально важливих об’єктів від електромережі у м. Щастя та з’ясовано, що така ситуація склалася через реформу органів самоврядування в частині децентралізації та створення ОТГ (об’єднаних територіальних громад), відповідно до положень якої значна частина споживачів бюджетної сфери з певних причин не мало змоги укласти договір на розподіл електричної енергії на поточний рік.
Згідно з Указом Президента України №62/2021від 19.02.2021 року «Про утворення та реорганізацію військово-цивільних адміністрацій у Луганській області» утворено Щастинську міську військово-цивільну адміністрацію Щастинського району Луганської області яка є тимчасовим державним органом, що здійснює на території міста Щастя повноваження Щастинської міської ради, її виконавчого комітету та інші повноваження, визначені Законом "Про військово-цивільні адміністрації".
Розпорядженням Президента України від 05.03.2021 №173/2021-рп призначено голову Щастинської районної державної адміністрації Луганської області.
Обласною державною адміністрацією - обласною військово-цивільною адміністрацією з керівником Щастинської міської військово-цивільної адміністрації досягнуто домовленостей щодо затвердження до 08.04.2021 місцевого бюджету з урахуванням сум заборгованості та оплати за спожиті енергоносії. З енергопостачальними компаніями досягнуто домовленостей про погашення заборгованості за спожиті енергоносії та незастосування ними заходів щодо припинення відповідних послуг до затвердження місцевих бюджетів.
Необхідно зазначити, що Розпорядженням керівника Щастинської міської військово-цивільної адміністрації м. Щастя від 06.04.2021 №37 «Про внесення змін до розпорядження від 24.03.2021 №17 «Про бюджет Щастинської міської територіальної громади Луганської області на 2021 рік» викладено у новій редакції з урахуванням вищезазначених питань.
